﻿{"id":787,"date":"2019-03-20T14:58:03","date_gmt":"2019-03-20T13:58:03","guid":{"rendered":"http:\/\/www.fmslex.com\/?p=787"},"modified":"2019-03-25T16:50:59","modified_gmt":"2019-03-25T15:50:59","slug":"bed-and-breakfast-in-condominio-e-legittimo","status":"publish","type":"post","link":"http:\/\/www.fmslex.com\/index.php\/2019\/03\/20\/bed-and-breakfast-in-condominio-e-legittimo\/","title":{"rendered":"Bed and Breakfast in condominio: \u00e8 legittimo?"},"content":{"rendered":"<h5>Bed and Breakfast in condominio: \u00e8 legittimo?<\/h5>\n<p style=\"text-align: justify;\">E\u2019 sempre pi\u00f9 frequenti nella nostre citt\u00e0 ed in particolare quelle a vocazione turistica veder sorgere attivit\u00e0 di <strong>Bed &amp;Breakfast<\/strong> vuoi per arrotondare o comunque per iniziare un\u2019attivit\u00e0 economica che dia buoni introiti. Ma \u00e8 l<strong>egittima l\u2019esercizio<\/strong> di tale attivit\u00e0 negli <strong>edifici condominiali<\/strong>?<\/p>\n<p style=\"text-align: justify;\">La Suprema <strong>Corte di Cassazione<\/strong> con la sentenza n. 24707 depositata in cancelleria il 20 novembre 2014 ne ha sentenziato la <strong>legittimit\u00e0<\/strong> sempre che <strong>non<\/strong> si verta in ipotesi di <strong>destinazione di spazi a vere e proprie attivit\u00e0 alberghiere.<\/strong><\/p>\n<p style=\"text-align: justify;\">Questa attivit\u00e0 \u00e8 stata oggetto di regolamentazione regionali e comunali.<\/p>\n<p style=\"text-align: justify;\">Il fatto concreto giunto al vaglio della suprema Corte riguardava una <strong>lite condominiale<\/strong>. Alcuni condomini avevano adibito la loro abitazione a <strong>B&amp;B<\/strong>. Il resto della compagine condominiale aveva instaurato un giudizio ritenendo illegittimo l\u2019esercizio di tale attivita in quanto, una clausola del regolamento condominiale poneva il divieto di destinare gli appartamenti \u201c<strong>ad uso diverso di quello di civile abitazione o uffici professionali privati\u201d.<\/strong><\/p>\n<p style=\"text-align: justify;\">La Corte ha confermato la sentenza d&#8217;appello, in quanto correttamente, ha ritenuto che \u201c<em>la disposizione regolamentare, tenuto conto che la destinazione a civile abitazione costituisce il presupposto per la utilizzazione di una unit\u00e0 abitativa ai fini dell&#8217;attivit\u00e0 di <strong>bed and breakfast<\/strong> (affermazione, questa, coerente con il quadro normativo di riferimento: art. 2, lett. a, del regolamento regionale Lazio n. 16 del 2008, in cui si chiarisce che &#8220;l&#8217;utilizzo degli appartamenti a tale scopo non comporta il cambio di destinazione d&#8217;uso ai fini urbanistici&#8221;; in proposito, vedi anche Corte cost. sent. n. 369 del 2008), non precludesse la destinazione delle unit\u00e0 di propriet\u00e0 esclusiva alla detta attivit\u00e0<\/em>\u201d (Cass. 20 novembre 2014 n. 24707).<\/p>\n<p style=\"text-align: justify;\">L\u2019attivit\u00e0 di Bed &amp; Breakfast infatti per sua natura richiede di essere svolta in <strong>unit\u00e0 abitative destinate a civile abitazione<\/strong> e quindi <strong>incompatibili<\/strong> con <strong>strutture abitative diverse quanto a destinazione d\u2019uso<\/strong>.<\/p>\n<p style=\"text-align: justify;\">L\u2019attivit\u00e0 di B&amp;B pertanto, <strong>non comportando mutamento di destinazione d\u2019uso<\/strong>, non si rivelava contraria alla specifica normativa regolamentare condominiale.<\/p>\n<p style=\"text-align: justify;\">Per vietare tale attivit\u00e0, occorrer\u00e0 prevedere nel regolamento condominiale una norma precisa e inequivocabile che <strong>vieti espressamente l\u2019esercizio di tale attivit\u00e0.<\/strong><\/p>\n<p><a href=\"http:\/\/www.ilcaso.it\/giurisprudenza\/archivio\/11752.pdf\" target=\"_blank\" rel=\"noopener\">http:\/\/www.ilcaso.it\/giurisprudenza\/archivio\/11752.pdf<\/a><\/p>\n<div class=\"pvc_clear\"><\/div>\n<p class=\"pvc_stats \" data-element-id=\"787\" style=\"\"><i class=\"fa fa-bar-chart pvc-stats-icon medium\" aria-hidden=\"true\"><\/i> 2,440&nbsp;Visite totali, 2&nbsp;visite odierne<\/p>\n<div class=\"pvc_clear\"><\/div>\n","protected":false},"excerpt":{"rendered":"<p>Bed and Breakfast in condominio: \u00e8 legittimo?
