﻿{"id":794,"date":"2019-06-10T08:13:46","date_gmt":"2019-06-10T06:13:46","guid":{"rendered":"http:\/\/www.fmslex.com\/?p=794"},"modified":"2019-03-28T08:29:35","modified_gmt":"2019-03-28T07:29:35","slug":"usucapione-di-parti-comuni-in-condominio","status":"publish","type":"post","link":"http:\/\/www.fmslex.com\/index.php\/2019\/06\/10\/usucapione-di-parti-comuni-in-condominio\/","title":{"rendered":"USUCAPIONE DI PARTI COMUNI IN CONDOMINIO"},"content":{"rendered":"<p style=\"text-align: justify;\">Il <strong>codice civile<\/strong> prevede l\u2019usucapione all\u2019art. <strong>1158 \u201c<em>La propriet\u00e0 dei beni immobili e gli altri diritti reali di godimento sui beni medesimi si acquistano jn virt\u00f9 del possesso continuato per venti anni<\/em>\u201d.<\/strong><\/p>\n<p style=\"text-align: justify;\">Ovviamente non baster\u00e0 dimostrare <strong>l\u2019uso ventennale<\/strong> ma occorrer\u00e0 provare di aver <strong>posseduto il bene<\/strong> apertamente comportandosi come il <strong>legittimo proprietario<\/strong> ad esempio ove si tratti di un terreno averlo coltivato, recintato, goduto dei frutti nella consapevolezza o nell\u2019indifferenza del legittimo proprietario inteso quest\u2019ultimo come colui che nei registri immobiliari risulta intestatario del bene.<\/p>\n<p style=\"text-align: justify;\">La norma tende a favorire<strong> l\u2019effettivo utilizzo del bene abbandonato<\/strong> piuttosto che la totale mancanza di una qualunque utilit\u00e0 del medesimo.<\/p>\n<p style=\"text-align: justify;\">Ma cosa succede se il bene costituisce una parte comune di un <strong>edificio condominiale<\/strong>? Si pensi all\u2019ipotesi di un sottotetto, un ripostiglio, una posto auto ecc.<\/p>\n<p style=\"text-align: justify;\">La questione \u00e8 un po\u2019 pi\u00f9 complicata poich\u00e9 in questo caso non baster\u00e0 utilizzare un bene come fosse proprio ma \u00e8 necessario che del <strong>medesimo bene sia interdetto l\u2019uso a tutti gli altri condomini<\/strong>. Ci\u00f2 pu\u00f2 avvenire ad esempio recintando una porzione di giardino o un posto auto o ancora apporre un lucchetto allo sgabuzzino ed essere l\u2019unico possessore delle chiavi di accesso.<\/p>\n<p style=\"text-align: justify;\">La Corte di Cassazione ha precisato che, affinch\u00e8 un <strong>condominio possa usucapire la quota degli altri non \u00e8 sufficiente che i condomini sia siano astenuti dall\u2019utilizzare il bene comune<\/strong>; occorrer\u00e0 infatti occorre altres\u00ec provare di aver sottratto tale area all\u2019uso comune per 20 anni. \u00a0In sostanza , per <strong>rivendicare l\u2019usucapione in condominio <\/strong>bisogna dimostrare una condotta rivolta contro i compossessori tale da impedire a questi ultimi di fare uso dello stesso spazio non bastando la semplice \u201castensione\u201d passiva degli altri.<\/p>\n<p><a href=\"https:\/\/www.brocardi.it\/codice-civile\/libro-terzo\/titolo-viii\/capo-ii\/sezione-iii\/art1158.html\" target=\"_blank\" rel=\"noopener\">https:\/\/www.brocardi.it\/codice-civile\/libro-terzo\/titolo-viii\/capo-ii\/sezione-iii\/art1158.html<\/a><\/p>\n<div class=\"pvc_clear\"><\/div>\n<p class=\"pvc_stats \" data-element-id=\"794\" style=\"\"><i class=\"fa fa-bar-chart pvc-stats-icon medium\" aria-hidden=\"true\"><\/i> 1,734&nbsp;Visite totali, 2&nbsp;visite odierne<\/p>\n<div class=\"pvc_clear\"><\/div>\n","protected":false},"excerpt":{"rendered":"<p>Il codice civile prevede l\u2019usucapione all\u2019art. 1158 \u201cLa propriet\u00e0 dei beni immobili e gli altri diritti reali di godimento sui beni medesimi si acquistano jn virt\u00f9 del possesso continuato per &#8230;<\/p>\n<div class=\"pvc_clear\"><\/div>\n<p class=\"pvc_stats \" data-element-id=\"794\" style=\"\"><i class=\"fa fa-bar-chart pvc-stats-icon medium\" aria-hidden=\"true\"><\/i> 1,734&nbsp;Visite totali, 2&nbsp;visite odierne<\/p>\n<div class=\"pvc_clear\"><\/div>\n","protected":false},"author":1,"featured_media":795,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[69,89],"tags":[663,76,256,664,662],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v23.4 -
